American Police Force Corporation Takes Over Small Town Police Force and Prisoner-Less Jail

This is the strange story of how American Police Force, a little known company which claims to specialize in training military and security forces overseas, has seemingly taken control of a $27 million, never-used jail, and a rural Montana town’s nonexistent police force.

After arriving in this tiny city with three Mercedes SUVs marked with the logo of a police department that has never existed, representatives of the obscure California security company said preparations were under way to take over Hardin’s jail, which has no prisoners.

Significant obstacles remain – including a lack of any contracts to acquire prisoners from other jails or other states.

And on Friday came the revelation the company’s operating agreement for the facility has yet to be validated – two weeks after city leaders first unveiled what they said was a signed agreement.

The lead public figure for American Police Force, Michael Hilton, said more than 200 employees would be sought for the jail and a proposed military and law enforcement training center.

But the company’s flashy arrival this week stirred new questions. The logo on the black Mercedes SUVs said “City of Hardin Police Department.”

Yet the city has not had a police force of its own for 30 years.

“Pretty looking police car, ain’t it?” Hardin resident Leroy Frickle, 67, said as he eyed one of the vehicles parked in front of a bed and breakfast where Hilton and other company representatives were staying. “The things you hear about this American Police, I don’t know what to think.”

Little has been revealed to date about American Police Force. The company was incorporated in California in March, soon after Hardin’s empty jail gained notoriety after city leaders suggested it could be used for the Guantanamo Bay terrorism detainees.

On Friday, American Police Force announced its first local hire: a reporter for the Billings Gazette, Becky Shay, who has covered events surrounding the jail since its construction. She will be the company’s spokeswoman for $60,000 a year.

Shay said she intended to bring new transparency to the process, but declined to directly answer the first question posed to her: Where is American Police Force getting the money to operate the jail and build the training center?

“I know enough about where the money is coming from to be confident signing on with them,” she said.

Calif. jail entrepreneur has checkered past

Michael Hilton pitched himself to officials in Hardin, Mont. as a military veteran turned private sector entrepreneur, a California defense contractor with extensive government contracts who promised to turn the rural city’s empty jail into a cash cow.

Hardin’s leaders were desperate to fill the $27 million jail, which has sat empty since its 2007 completion.

So when Hilton came to town last week — wearing a military-style uniform and offering three Mercedes SUVs for use by local law enforcement — he was greeted with hugs by some grateful residents. The promise of more than 200 new jobs for a community struggling long before the recession hit had won them over.

But public documents and interviews with Hilton’s associates and legal adversaries offer a different picture, that of a convicted felon with a number of aliases, a string of legal judgments against him, two bankruptcies and a decades-long reputation for deals gone bad.

American Police Force is the company Hilton formed in March to take over the Hardin jail.

“Such schemes you cannot believe,” said Joseph Carella, an Orange County, Calif. doctor and co-defendant with Hilton in a real estate fraud case that resulted in a civil judgment against Hilton and several others.

“The guy’s brilliant. If he had been able to do honest work, he probably would have been a gazillionaire,” Carella said.

Court documents show Hilton has outstanding judgments against him in three civil cases totaling more than $840,000.

As for Hilton’s military expertise, including his claim to have advised forces in Iraq and Afghanistan, those interviewed knew of no such feats. Instead, Hilton was described alternately by those who know him as an arts dealer, cook, restaurant owner, land developer, loan broker and car salesman — always with a moneymaking scheme in the works.

Hilton did not return several calls seeking comment. American Police Force attorney Maziar Mafi referred questions to company spokeswoman Becky Shay.

When asked about court records detailing Hilton’s past, Shay replied, “The documents speak for themselves. If anyone has found public documents, the documents are what they are.”

Shay declined comment on Hilton’s military experience.

ACORN May Face Trial for First Time as Nevada Prosecutors Allege ‘Widespread’ Criminal Policies

When ACORN took to Las Vegas and started playing “Blackjack” and “21,” the activist group was making a far bigger gamble than it ever guessed, according to Nevada prosecutors.

There’s nothing wrong with playing the tables in Vegas, but authorities say ACORN was using the names of those casino games as a cover to illegally pay workers to sign up voters as part of an illegal quota system.

A preliminary hearing Tuesday in the downtown Clark County courthouse has put ACORN on trial for the first time as a criminal defendant.

Until now, prosecutions for voter registration fraud have focused on ACORN workers, and authorities have secured guilty pleas from several who admitted to falsifying voter registration forms.

But when investigators from Nevada Secretary of State Ross Miller’s office raided the ACORN Las Vegas office, Ross says they found a paper trail that implicated the ACORN organization itself.

“We came across policy manuals that outline their policy of creating a quota system, which is against the law,” Miller told FOX News in an interview. “This, in fact, was something that was widespread and something the organization itself knew about, and it’s important to hold the organization criminally accountable as opposed to the individual field directors.”

ACORN denies it had a quota for the number of voter registration forms that its workers were required to turn in every day. Instead, the organization says there were “performance standards” — an expectation that workers would find 20 new voters a day.

But prosecutors say ACORN paid a $5 bonus per day to workers who would sign up 21 or more voters per shift, hence the name “21″ or “Blackjack,” an alleged quota system that Ross says is the first step toward corrupting the democratic system.

“These charges strike at the heart of having integrity of the electoral process. That’s something that is important in Nevada and the entire country,” he told FOX News.

“By filing these charges we are sending a clear message we are not going to tolerate these kinds of activities. We have seen voter registration abuse before and we are holding these people accountable.

Affidavits: Ballot abuse rampant

Dozens of forged and fraudulent absentee ballots from people registered to vote on the Working Families Party line were filed in the Sept. 15 primary elections in Troy, the Times Union has learned.

Many of the questionable ballots were filed under the names of students and people who live in government-subsidized housing and other downtown areas. Still others were submitted on behalf of voters who were alleged to have signed the ballots earlier this month, but those people have not lived in New York state for at least a year, records show.

Documents at the county Board of Elections show the fraudulent ballots were handled by or prepared on behalf of various elected officials and leaders and operatives for the Democratic and Working Families parties. A Troy housing authority employee, Anthony Defiglio, who sources said oversees vacant properties for the Troy Housing Authority, also handled many of the fraudulent ballots, according to public records and interviews with voters who said they were duped.

With No Fanfare, Senate Hits ACORN, Again

With no fanfare and no roll call vote, not even a speech — the Senate on Tuesday unanimously approved an amendment by Sen. Mike Johanns, R-NE, that bars any funds from the Defense spending bill from going to ACORN.

Johanns promised to introduce a similar amendment on every spending bill Congress considers this year, until the chamber takes up his broader bill that would impose permanent ban on ACORN receiving any federal funds.

It took the Senate a little over one minute to consider the measure.

Bank of America pulls ACORN funding

Troubled community organizing group ACORN suffered another setback on Monday, when Bank of America announced it is pulling its funding of ACORN Housing.

In a statement, Bank of America said that is it “suspending current commitments to ACORN Housing and will not enter into any further agreements with ACORN or any of its affiliates” until it is satisfied that all issues related to the organization have been resolved.

Obama Czar, Making NAMBLA Proud

I have no idea whether Kevin Jennings, the newest lowlife Obama Czar to come to llight, is a member of the North American Man/Boy Love Association or not, but he sure as hell seems to share their values. Kevin Jennings has admitted encouraging and, as a teacher, not reporting as required by law, an illegal homosexual relationship between an adult and a child. Hey, I’ve got a great idea, why don’t we make Kevin Jennings the national “safe school czar”?

And this is hardly the first Obama Czar with more than questionable credentials. It’s a big country, are these the best and the brightest the Obama administration can find? The question you really need to ask yourself is, are the Obama administration vetters that clueless and incompetent or do they choose these reprobates on purpose? Either explanation is frightening and unacceptable.

At the president’s pleasure

A teacher was told by a 15-year-old high school sophomore that he was having homosexual sex with an “older man.” At the very least, statutory rape occurred. Fox News reported that the teacher violated a state law requiring that he report the abuse. That former teacher, Kevin Jennings, is President Obama’s “safe school czar.” It’s getting hard to keep track of all of this president’s problematic appointments. Clearly, the process for vetting White House employees has broken down.

In this one case in which Mr. Jennings had a real chance to protect a young boy from a sexual predator, he not only failed to do what the law required but actually encouraged the relationship.

According to Mr. Jennings’ own description in a new audiotape discovered by Fox News, the 15-year-old boy met the “older man” in a “bus station bathroom” and was taken to the older man’s home that night. When some details about the case became public, Mr. Jennings threatened to sue another teacher who called his failure to report the statutory rape “unethical.” Mr. Jennings’ defenders asserted that there was no evidence that he was aware the student had sex with the older man.

However, the new audiotape contradicts this claim. In 2000, Mr. Jennings gave a talk to the Iowa chapter of the Gay, Lesbian and Straight Education Network, an advocacy group that promotes homosexuality in schools. On the tape, Mr. Jennings recollected that he told the student to make sure “to use a condom” when he was with the older man. That he actively encouraged the relationship is reinforced by Mr. Jennings’ own description in his 1994 book, “One Teacher in 10.” In that account, the teacher boasts how he allayed the student’s concerns about the relationship to such a degree that the 15-year-old “left my office with a smile on his face that I would see every time I saw him on the campus for the next two years, until he graduated.”

Last week the market lost ground with the NYSE composite slipping 2.8%, the S&P 500 giving up 2.2%, the Nasdaq falling 2% and the Dow down 1.6%. The IBD outlook is still “market in confirmed uptrend” although the indexes picked up a couple distribution days.

This week, the same two watch list stocks as last week are still potential buy candidates, GMCR and PEGA. GMCR, trading at $68.93, may be forming a handle on a cup pattern with a buy point of $72.10, wait for it to clear the buy point on volume. PEGA is trading at $33.25 and is in buy range anywhere up to $34.91 after finding support at its ten week line several weeks ago.

Closing Guantanamo was one of Obama’s major campaign promises, along with making the war in Afghanistan a top priority, yet another major campaign promise he seems to be reneging on. Well, well, well, looky here, Obama says not so fast on that closing Guantanamo within a year promise.

Guantanamo prison not likely to close in January, officials say

The U.S. military prison at Guantanamo Bay, Cuba, is unlikely to close by the Obama administration’s deadline of January 2010, two senior administration officials said late Friday.

They cited legal complications for the delay, but said they were still optimistic about shutting the detention facility for terrorism suspects soon.

The announcement represents a blow to the president, who signed an executive order and set the deadline with great fanfare during his first week in office.

During a signing ceremony at the White House on January 22, Obama reaffirmed his inauguration pledge that the United States does not have “to continue with a false choice between our safety and our ideals.”

The president said he was issuing the order to close the prison camp in order to “restore the standards of due process and the core constitutional values that have made this country great even in the midst of war, even in dealing with terrorism.”

The delay may provide fodder for Republicans such as former Vice President Dick Cheney, who has argued that shutting the Guantanamo prison would make the United States less safe. He said Obama should have had a detailed plan in place before signing the order.

“Even White House officials are now acknowledging that there is still no alternative that will keep Americans as safe as housing detainees at that secure facility off our shores,” Senate Minority Leader Mitch McConnell, R-Kentucky, said in a written statement.

“Americans and a bipartisan majority in Congress will continue to reject any effort to close Guantanamo until there is a plan that keeps Americans as safe or safer than keeping detainees in the secure detention center,” McConnell’s statement said.

Gee, maybe they should have actually had a plan before Obama shot his mouth off and set a deadline. But hey, it’s much easier to just blame Bush and the Republicans.

Even before the inauguration, President Obama’s top advisers settled on a course of action they were counseled against: announcing that they would close the facility within one year. Today, officials are acknowledging that they will be hard-pressed to meet that goal.

The White House has faltered in part because of the legal, political and diplomatic complexities involved in determining what to do with more than 200 terrorism suspects at the prison. But senior advisers privately acknowledge not devising a concrete plan for where to move the detainees and mishandling Congress.

To address these setbacks, the administration has shifted its leadership team on the issue. White House Counsel Gregory B. Craig, who initially guided the effort to close the prison and who was an advocate of setting the deadline, is no longer in charge of the project, two senior administration officials said this week.

Craig said Thursday that some of his early assumptions were based on miscalculations, in part because Bush administration officials and senior Republicans in Congress had spoken publicly about closing the facility. “I thought there was, in fact, and I may have been wrong, a broad consensus about the importance to our national security objectives to close Guantanamo and how keeping Guantanamo open actually did damage to our national security objectives,” he said.

Senior administration officials said the central roadblock during those early months was the condition of the detainee files, which had been left in disarray by the previous administration.

See? It’s Bush’s fault, the universal Obama excuse for everything! Nevermind the obvious fact that we’re still stuck with 225 of the world’s worst terrorists because we can’t find any other country, in their right mind, that will agree to take them, not even their home countries.

They’re torturing me, Honduras’ Manuel Zelaya claims

It’s been 89 days since Manuel Zelaya was booted from power. He’s sleeping on chairs, and he claims his throat is sore from toxic gases and “Israeli mercenaries” are torturing him with high-frequency radiation.

“We are being threatened with death,” he said in an interview with The Miami Herald, adding that mercenaries were likely to storm the embassy where he has been holed up since Monday and assassinate him.

Honduran police spokesman Orlin Cerrato said he knew nothing of any radiation devices being used against the former president.

“He says there are mercenaries against him? Using some kind of apparatus?” Cerrato said. “No, no, no, no. Sincerely: no. The only elements surrounding that embassy are police and military, and they have no such apparatus.”

Israeli government sources in Miami said they could not confirm the presence of any “Israelis mercenaries” in Honduras.

It turns out that it wasn’t a “coup” at all, under Honduran law, the removal of former President Zelaya was Constitutional.

In response to the ouster of Honduran President Manuel Zelaya, the U.S. State Department cut off foreign aid to Honduras and stopped approving visas for government officials. The U.S. is even threatening now to de-legitimize that nation’s upcoming November elections, and has been treating the interim government of Roberto Micheletti as a rogue regime.

But State’s is not the only opinion. By way of contrast, a new report (click here for the pdf) from the Congressional Research Service bears out what our editorial board has been pointing out for months now: The situation in Honduras should not be a cause for concern in Washington. It should a relief.

President Zelaya, who was attempting to subvert the constitutional order of Honduras by seeking re-election (considered a crime there) was removed from office by the order of civilian authorities, and the constitutional order of succession was honored afterward.

“The nonpartisan Congressional Research Service concluded the removal of former President Zelaya was Constitutional, and we must respect that,” Rep. Aaron Schock said today. “It’s unconscionable the administration would attempt to force Honduras to violate its own Constitution by cutting of foreign aid.”
