Two men charged with plan to attack military recruiting station

Two U.S. citizens from Seattle and Los Angeles — described as “would-be terrorists” by the FBI — have been arrested and charged with plotting to kill Americans enlisting in the armed forces in Seattle, federal officials announced Thursday.

The men were identified as Abu Khalid Abdul-Latif, (also known as Joseph Anthony Davis), 33, of Seattle; and Walli Mujahidh, (also known as Frederick Domingue Jr.) 32, of Los Angeles.

“Driven by a violent extreme ideology, these two young Americans are charged with plotting to murder men and women who were enlisting in the armed forces to serve and protect our country,” said a top counter-terrorism official at the Justice Department.

According to a source working with federal agents, Abdul-Latif said the original plan to attack Fort Lewis “would be in retaliation for alleged crimes committed by United States soldiers in Afghanistan,” a court document said.

The plot allegedly involved a conspiracy to use grenades and firearms which they would use to kill the victims and then use to fight police as they made their escape.

I must say that it’s truly remarkable how the FBI manages to foil so many terror plots before they come to fruition. Then again, since the plots just about always involve jihadis, the FBI knows where to look and who to look for.

Mubarak family fortune could reach $70bn, say experts

President Hosni Mubarak’s family fortune could be as much as $70bn (£43.5bn) according to analysis by Middle East experts, with much of his wealth in British and Swiss banks or tied up in real estate in London, New York, Los Angeles and along expensive tracts of the Red Sea coast.

After 30 years as president and many more as a senior military official, Mubarak has had access to investment deals that have generated hundreds of millions of pounds in profits. Most of those gains have been taken offshore and deposited in secret bank accounts or invested in upmarket homes and hotels.

You still can’t legally yell fire in a crowded theater, but thanks to the 9th Circuit Court of Appeals, it’s now your Constitutional right to pretend that you’re a member of the military and fraudulently wear fake medals in public.

Court again strikes down Stolen Valor Act

A federal appeals court panel ruled Tuesday that people have a right to lie about receiving military medals, the second federal court decision in a month to go against the Stolen Valor Act.

Xavier Alvarez, who falsely claimed in 2007 to have received the Medal of Honor, challenged the law on appeal after he was charged with violating the act, which makes it a crime to falsely claim to have won a military medal.

Alvarez said the act is a violation of free-speech rights.

A panel of the 9th Circuit Court of Appeals sided with Alvarez in a 2-1 decision.

The majority said there was no evidence that such lies harm anybody, and there is no compelling reason for the government to ban such lies.

The U.S. Attorney’s Office in Los Angeles said it is deciding whether to appeal the ruling.

No evidence that such lies harm anybody, how about the psychological harm to all the real veterans who actually served and were awarded real medals for their real sacrifices and real wounds? And what about the pain felt by the families of those medal recipients who gave the ultimate sacrifice?

Maxine Waters faces ethics charges

A House panel is preparing to accuse Rep. Maxine Waters of at least one ethics violation in her efforts to help a bank with ties to her husband, and the longtime Los Angeles Democrat plans to fight the charges in a House trial, according to a source familiar with the case.

The allegations were presented Friday to Waters, the source said, speaking on the condition of anonymity because the investigation is confidential.

Waters, an outspoken legislator who has held elective office in Sacramento or Washington for more than three decades, could not be reached Friday night.

The findings on the investigation into Waters by the Office of Congressional Ethics are expected to be made public on Monday.

That office, an independent watchdog created by Congress, referred the matter to the House Ethics Committee. The committee turned the matter over to a panel of two Democratic and two Republican lawmakers who have been conducting their own probe for months.

The allegations come as Rep. Charles B. Rangel (D-N.Y.) faces a House trial on 13 ethics allegations, adding to the political troubles of Democrats confronted with a tough battle to hold onto their House majority in the November midterm election. Rangel, 80, and Waters, 71, are both high-profile, longtime members of the Congressional Black Caucus.

One of Los Angeles’ most enduring black politicians, Waters came under scrutiny last year after Massachusetts-based OneUnited Bank, one of the nation’s largest minority-owned institutions, received $12 million in bailout funds.

The funding came three months after Waters, a senior member of the committee that oversees banking, helped arrange a meeting between officials of the bank, other minority-owned financial institutions and Treasury Department representatives.

Waters’ husband, Sidney Williams, had owned stock in the bank and served on its board.

Chessboxing Hits Los Angeles

Chessboxing, the European breakout sport invented by a German artist, Iepe B.T. Rubingh finally has a bastion in the USA, the LA Chessboxing Club. But LA Chessboxing club founder Andrew McGregor has a different slant on the sport. The LA Club, which is sanctioned by the World Chess Boxing Organization, requires fighters to wear headgear, reducing the chance of injury and allowing less experienced boxers to fight.

McGregor told CLO that European healthcare might make chessboxers there more comfortable with the enhanced risk of their fights. By reducing the risk McGregor wants to open the sport up to more people, including women (who have never contested a chessboxing match before.)

Rich Cling to Life to Beat Tax Man

Nothing’s certain except death and taxes — but a temporary lapse in the estate tax is causing a few wealthy Americans to try to bend those rules.

Starting Jan. 1, the estate tax — which can erase nearly half of a wealthy person’s estate — goes away for a year. For families facing end-of-life decisions in the immediate future, the change is making one of life’s most trying episodes only more complex.

“I have two clients on life support, and the families are struggling with whether to continue heroic measures for a few more days,” says Joshua Rubenstein, a lawyer with Katten Muchin Rosenman LLP in New York. “Do they want to live for the rest of their lives having made serious medical decisions based on estate-tax law?”

Currently, the tax applies to about 5,500 taxpayers a year. So, on average, at least 15 people die every day whose estates would benefit from the the tax’s lapse.

The macabre situation stems from 2001, when Congress raised estate-tax exemptions, culminating with the tax’s disappearance next year. However, due to budget constraints, lawmakers didn’t make the change permanent. So the estate tax is due to come back to life in 2011 — at a higher rate and lower exemption.

To make it easier on their heirs, some clients are putting provisions into their health-care proxies allowing whoever makes end-of-life medical decisions to consider changes in estate-tax law. “We have done this at least a dozen times, and have gotten more calls recently,” says Andrew Katzenstein, a lawyer with Proskauer Rose LLP in Los Angeles.

Of course, plenty of taxpayers themselves are eager to live to see the new year. One wealthy, terminally ill real-estate entrepreneur has told his doctors he is determined to live until the law changes.

“Whenever he wakes up,” says his lawyer, “He says: ‘What day is it? Is it Jan. 1 yet?'”

Estate-tax experts didn’t expect Congress to allow the tax to lapse, and are flabbergasted that it is actually happening. “All fall when I gave speeches, I said I was willing to bet anyone in the room $10 that we would have an estate-tax extension by the end of the year,” says Thomas Ochsenschlager, head of taxes for the American Institute of CPAs. “Thank goodness I didn’t have any takers,” he says.

Now, all bets are off. “If Congress couldn’t do it this year, why will they be able to do it next year?” says Prof. Michael Graetz of Columbia University, who worked both at Treasury and for Congress. He calls the lapse “congressional malpractice.”

Under current laws in effect until the end of this year, the size of the exemption is $3.5 million per individual or up to $7 million per couple. The tax is slated to disappear entirely on Jan 1.

But estate planning in 2010 will be complicated by a new twist: a complex tax on capital gains that will affect a broader swath of taxpayers. The estate tax is scheduled to return in 2011 at a 55% rate with an exemption of slightly more than $1 million.

The looming lapse of the estate tax is presenting some families with unprecedented ethical quandaries.

“I’ve been practicing for more than 30 years, and never has the timing of death made such a financial difference,” says Dennis Belcher, president of the American College of Trust and Estate Counsel. “People have a hard enough time talking about death and addressing estate planning without this.”

Of course, if Congress does nothing to fix this mess, the perverse opposite of what is occurring now will transpire. Instead of keeping loved ones on life support to make it until 2010, when there’s no Federal estate tax, some families will have to decide whether or not to pull the plug on their loved ones in 2010, before the 55% estate tax rate returns in 2011.
